The European Commission proposes a comprehensive definition of AI in the AI Act. It is broadly defined as a system that is either software-based or embedded in hardware devices and is designed to perform tasks that would typically require human intelligence. The AI Act is currently in the proposal stage, and there is no specific timeline as to when it will come into force. The act needs to be approved by the European Parliament and the Council of the European Union. The AI Act covers a broad spectrum of AI systems and applications to ensure safe, transparent, and reliable usage of AI across multiple sectors. Enforcement is crucial in the realization of the objectives of the AI Act.

Exploitation of Vulnerabilities: AI systems that exploit vulnerabilities due to a person's age, disability, or specific social or economic situation to materially distort their behavior in a harmful manner are banned. Social Scoring: The Act prohibits AI systems that evaluate or classify people based on their social behavior or predicted personal characteristics, leading to detrimental treatment in unrelated social contexts or in a manner that is disproportionate or unjustified. With the historic release of the EU Parliament's approved text of the EU AI Act yesterday and the creation of The Talking EU AI Act today, we have the world's most comprehensive attempt at grappling with its greatest technological achievement and the ability to learn and probe into that framework through ordinary conversation at any time and before any but a few humans fully understand it. The prohibitions of certain practices concerning the development, deployment, and use of AI systems become effective 6 months after the Act's effective date and involve penalties potentially almost double those of the GDPR, so let's start with a detailed presentation of those prohibitions in Article 5. Subliminal Manipulation: The use of AI systems that deploy subliminal techniques or manipulative or deceptive practices to materially distort a person's behavior, significantly impairing their ability to make informed decisions. Such actions are prohibited if they cause, or are likely to cause, significant har

When Brussels watched AI leap from research labs to everyday lives around 2018, alarm bells rang. With scandals like Cambridge Analytica fresh in mind, the EU knew it needed guardrails. Fast forward: In April 2021, the EU proposed the AI Act, Europe’s bid to balance innovation with fundamental rights. The Act becomes mandatory in August 2026, but waiting is risky. Use this time to prepare - compliance will soon be a market access prerequisite. AI is classified into 4 risk levels: Minimal, Limited, High, and Unacceptable. Recently, while training AI-focused climate-tech startups from Climate KIC in the UK and Ireland, I was struck by one thing: how profoundly unclear the EU AI Act still is to the entrepreneurs who need clarity the most. These are not casual users of technology, they're innovators racing to mitigate climate change, entrepreneurs whose ideas promise tangible benefits for the planet. On December 8th, 2023, the European Union passed an AI act that could influence global perspectives on how we view and use artificial intelligence. Although this long-maturing piece of legislation won't be enacted until around 2025, the whole ... However, in a 2023 legislative session, generative AI laws addressing the issue of privacy were introduced. Around 25 states, Puerto Rico and the District of Columbia have introduced artificial intelligence bills. Currently, 15 states and Puerto Rico have enacted some form of legislation. These laws include Montana’s SB384 Act, the California Consumer Privacy Act (CCPA), the Connecticut Privacy Act(CTPA), and the Colorado Privacy Act (CPA). Generative AI providers must operate within and uphold the integrity of state power that protects the existing social order, which thus forces users to comply with AI systems whether they agree or not. In October 2023, the Biden administration announced a landmark executive order with similar actions as outlined in the EU’s AI Act. With the European Union’s new AI Act, all eyes are on the Biden administration to see what the United States' next steps will be. Will the executive branches work together swiftly to come up with terms of agreement on Biden’s proposal? The EU’s AI Act sets specific criteria that seek to protect its citizens from AI abuse, while still welcoming the opportunities gifted by this mammoth tech discovery.

With the MDR and the IVDR compliance dates having been pushed forward, the compliance date of the AI Act will likely coincide. For example, the ultimate compliance date is set at the 31st of December 2028. The AI Act is expected to come into effect in 2024, with a transition period of two years. On Friday the 8th of December the trilogue continued until late when a final agreement was struck between the Parliament and the Council. This effectively means that the basic outline of the AI Act has been agreed on, and the finalization of the text can begin. Another timeline to watch out for is the timeline on prohibited AI systems, which will already be enforced 6 months after the coming into force of the AI Act. If a prohibited form of AI is included in a device, one will need to consider whether such application may still be marketed. With the final text being agreed and the AI Act (very likely) coming into force in 2024, we will need to keep a close watch on Notified Bodies and their preparedness to audit against the AI Act. For example, a Notified Body will need to file an application to become a conformity assessment body under the AI Act (article 31 in the Council proposal).

The AI Act’s threshold will be that models whose training required more than 10^25 FLOPS (more than 10 trillion trillion) of computer power will automatically be considered as high-impact GPAIs. The political alignment is especially an important achievement considering that for a brief moment of time, it looked as if the AI Act could be stymied by lobbying efforts from Big Tech companies. As I wrote about last week, the regulation of ā€œfoundation modelsā€ was particularly a controversial talking point. Luckily, the EU policymakers have agreed on not exempting foundation models from the legislation. This is what I will write a bit more about today along with the other important principles and provisions we can expect from the AI Act. This would exempt, the French AI company Mistral AI’s newest model Mixtral-8x7B and Meta AI’s Llama 2. Additionally, AI systems used for the sole purpose of research and innovation are not included in the requirements, as these are explicitly not covered by the scope of the AI Act. Additional obligations will be imposed on ā€œhigh-impact GPAI models with systemic riskā€. In line with Biden’s Executive Order from October 30, the threshold to decide if a GPAI model is "high impact" is mainly based on the amount of computing power used to train the model, measured in floating point operations per second (FLOPS). High-risk use cases (like AI in recruitment, credit scoring, biometric ID, etc.) can significantly impact people’s lives. The AI Act mandates that before such systems are deployed or sold in the EU, providers and deployers implement numerous ā€œtrustworthinessā€ measures. The AI Act imposes comprehensive requirements on developers of high-risk AI systems, encompassing risk management, data governance, monitoring, record-keeping, transparency, human oversight, and cybersecurity. Mechanisms such as Data Spaces and Minimal Interoperable Mechanisms (MiMs) that support transparency will enable the same business opportunities with guarantees. Let's understand in this newsletter what is inside the AI Act and how it can be addressed with the Data Spaces technology and mechanisms as the FAIR AI MIM5, which I have the honour of being part of the Working Group, and you are also welcome to contribute. The alternatives and solutions, such as crowd management, should avoid the use of video images and face recognition, as we have proposed alternatives based on RF signal analysis to be aligned with the GDPR and AI Act. The AI Act imposes comprehensive requirements on developers of high-risk AI systems, encompassing risk management, data governance, monitoring, record-keeping, transparency, human oversight, and cybersecurity. The limited risk category covers systems with reduced potential for manipulation, subject to specific transparency obligations. Minimal or no-risk AI systems do not fall under any other category, implying less stringent regulatory requirements. While the Act is a significant step forward, it raises questions about the balance between innovation and regulation.

🧠 AI Assessment: Directly addresses the EU AI Act, a cornerstone of European AI regulation and digital sovereignty.

The world’s first comprehensive legal framework for artificial intelligence — the EU AI Act — began taking effect in February 2025, with full enforcement expected by the end of 2030. It defines which AI systems can be used in the EU, as well as compliance requirements and strict penalties for non-compliance. The Act will affect most (if not all) existing and future AI products. AI development generally follows this pattern: The US innovates, the EU regulates. For now, AI technology is growing faster than the regulations surrounding it, and the EU AI Act is the latest attempt to balance innovation with end-user safety. It also has a special set of requirements for general-purpose AI (GPAI) products like ChatGPT or Claude. Since these products can serve more than one purpose, it’s impossible to assess their potential risks based on applications and use cases. Instead, the AI Act evaluates them based on the model’s computational power and systemic risk. What’s covered: AI systems that are used for legitimate purposes but can seriously impact health, safety, and rights of a person (e.g. analytics tools in healthcare, finance, transportation, learning systems, remote biometric identification) Requirements: Risk assessment, activity logging, dataset quality standards, transparent and detailed documentation, and more

After a marathon three-day negotiation by the trialogue composed of the European Commission, Council, and Parliament, on December 8, 2023, they approved the AI Act to regulate the use of artificial intelligence systems in the European Union. This outcome was by no means a foregone conclusion until a few days ago after the French, German, and even Italian governments called for replacing the AI Act with the adoption of a mere code of conduct to decrease regulatory obligations on European companies to enable them to better compete in the international arena. European legislators disagreed with this approach, believing (in my opinion, rightly so) that a balanced regulation would have instead forced foreign companies to comply with the AI Act as well, creating a more balanced environment that would have allowed for fairer competition. A further highly discussed exception to the applicability of the AI Act operates in relation to AI systems exploiting free and open source software. But the scope of the exception is so narrow that basically it will apply only to personal usage of artificial intelligence.

This growing focus on digital sovereignty is an increasingly relevant issue at the national and European level, as demonstrated by the agreement between the Italian and French economics ministries for a common digital strategy, which includes sovereignty as a key theme. Currently, there is no single definition of this concept. The urgency to regulate the use of data risks generating a 'hashtag' effect, with each provider attempting to bring its dynamics under the umbrella of digital sovereignty to establish its relevance (a bit like what happened at the time with the term 'cloud'). Although technology has not yet reached this point, a true VR environment will engage all five senses (taste, sight, smell, touch, sound), but it is important to say that this is not always possible. From the user's perspective, VR produces the felt experience of "presence" - i.e., the user feels physically present in the digital environment, irrespective of where they are actually located at the time. 🧠 AI Assessment: Directly addresses European digital sovereignty, data sovereignty risks, and national security implications.

Digital sovereignty refers to a nation's ability to manage its own digital assets, including data, networks, and services, free from external influence or control. The commercial exploitation of personal data by corporations not only affects individual privacy but also compromises national security. Data harvested and stored in foreign lands can be exploited or even weaponized, diminishing the digital sovereignty of the nation from which the data originates. In this blog post, we'll delve deep into the multifaceted crisis affecting digital sovereignty and explore ways to fortify it. 🧠 AI Assessment: Directly addresses European digital sovereignty, strategic infrastructure, and EU policy initiatives with specific examples.

Call it the geopolitics of digital technologies or the awareness that we must participate in the ongoing competition for technological leadership between the U.S. The turning points from the European Commission about the importance of data and digital technologies are various. European Commission President Ursula von der Leyen, in the State of the European Union (SOTEU) 2022, announced a push to create a new fund for European sovereignty: ā€œI will push to create a new European Sovereignty Fund. Let's make sure that the future of industry is made in Europe.ā€ The push focuses, among other points, on digital and data as elements of strategic focus along with cybersecurity, cloud, edge, etc. For more background, read "A European Sovereignty Fund for an industry Made in Europe." Even the French presidency announced it in The Building Europe's Digital Sovereignty conference to take stock of recent progress on the continent, initiate discussions and create momentum to continue building Europe's digital sovereignty and show how the European Union can take charge of its destiny in the digital age. Wish to point out that an efficient key management system, scalability and interoperability of the solutions and well established standards are some of its challenges and open problems to wide deployments of digital sovereignty and its sibling data sovereignty.

🧠 AI Assessment: Directly addresses European AI sovereignty, data sovereignty, and competitiveness with policy recommendations.

We argue that indeed data sovereignty is a crucial enabler for AI in Europe and the proposed measures are a leap in the right direction. However, it is only the first step towards AI sovereignty, and AI sovereignty should not be pursued at the cost of AI competitiveness as both are critical to each other. As Thierry Breton, European Commissioner for Internal Market and Services states, ā€œthe industrial data war has started now, and Europe will be its main battlefieldā€. This strategy presents a push towards European data sovereignty. So what does it mean for AI in Europe? We argue that indeed data sovereignty is a crucial enabler for AI in Europe and the proposed measures are a leap in the right direction. However, it is only the first step towards AI sovereignty, and AI sovereignty should not be pursued at the cost of AI competitiveness as both are critical to each other. To avoid a potentially harmful trade-off between AI sovereignty and competitiveness we suggest five key recommendations to European policy makers and business leaders that are relevant for many of the world’s large economies (e.g. The proposed European data strategy drives data sovereignty as it aims to create large datasets based on European rules, invest in European data capabilities and infrastructures, and empower individuals, and SMEs.

A new technology typically triggers a race among the industry players, however, Artificial Intelligence has the unique honor of triggering a race among the countries of the world. Few say it was triggered by Google Alpha GO defeating the best GO player. The game of GO is considered the ultimate test of human intelligence and a national pride. China responded by releasing its plan for AI dominance and triggering a domino effect among the countries. United States: Currently the US and China are the leaders in AI research. The US has a slight advantage due to its well-established technology giants and research bodies. In Dec 2016, the Obama administration released 3 separate reports on AI. Since then no strategic report has been published. AI advancement in the US is largely driven by the private sector without any reinforcement from the government. In May 2018, the White House invited industry, academia, and government representatives to a summit on AI. China: In July 2017 China released its New Generation AI Development Plan, a three-step roadmap to becoming a world leader in AI. China through its AI strategy roadmap would like to be the ā€œWorld Leaderā€ by 2025 and ā€œPrimary AI innovation centerā€ by 2030.

A recent industry survey found that 37% of companies rank data science, ML and AI as the single most important factor for growth. Would we have a world where we have digital clones of our bodies, live recording interactions of every movement and change in our body? At some level, we already have it, with smartwatches that provide us with basic data on respiration, sleep patterns, and heart rate. And AI is making far greater strides than we ever imagined. 🧠 AI Assessment: Discusses AI regulation and trust dynamics but lacks direct focus on European AI sovereignty or GDPR.

Let’s face the question again, who is going to win the AI race? The answer is - No one knows. The AI race is still in its early stages, but it is clear that the winner will be the company that can master the three dynamics of computation, distribution, and trust. As it turned out, while predictions were being made for the companies that are going to win the internet economy, some individuals who built the real winners of the internet economy were still in university, high school (in one specific case, most likely in middle school). Something very similar is going to happen with the AI race: the rules are still being written, and changes are happening much faster than any technical revolution of the past. Once the dust settles, people's understanding of AI matures, governments are done with their policy framework, PRs are done with creating jazzy marketing buzz, and thought leaders are done recycling their thought articles on "how AR/crypto/metaverse/chatGPT can cure world hunger", the AI race will become a combination of dynamics: computation, distribution, and trust. The product built on trust and safety as a central core will be the winner. Trust and safety will not be a feature of an AI product, Trust & safety will be the product, AI is just a delivery mechanism. The winner in the AI race has to be trusted by its user to do the right thing, not for a few users but for billions of users. Let’s face the question again, who is going to win the AI race? The answer is - No

🧠 AI Assessment: Discusses global AI competition with a focus on ethical governance and mentions Europe among leading regions, touching on broader AI regulation and policy.

The AI race, also known as the global competition to lead in the development and deployment of artificial intelligence (AI) technologies, has been an increasingly prominent topic in recent years. Furthermore, there are concerns that the intense competition in the AI race could lead to a ā€œwinner takes allā€ dynamic, where a small number of countries or companies are able to dominate the global AI landscape, leading to a concentration of power and resources that could have negative consequences for other actors. Given the potential benefits and risks of the AI race, it is clear that some degree of global cooperation and coordination is necessary in order to ensure that the development and deployment of AI technologies are guided by ethical considerations and a focus on the common good. Ultimately, the AI race is a complex and multifaceted issue that will require ongoing attention and effort from a wide range of stakeholders, including governments, industry leaders, academics, and civil society organizations. There are a number of countries that are currently considered to be leading the charge in the AI race, including the United States, China, and several countries in Europe.
